AGREEMENT TO TERMS

These Terms and Conditions (“Terms”) govern your access to and use of the WAWebSender website, browser extension, and related services and features (collectively, the “Services”).

By accessing or using WAWebSender, you confirm that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, you should not access or use the Services.

WAWebSender provides browser-based tools designed to work with WhatsApp Web, including contact import, personalized message preparation, message templates, attachments, sending controls, and related messaging workflow features.

You are responsible for ensuring that your use of WAWebSender complies with all laws, regulations, and third-party platform rules applicable to you.

We may update these Terms from time to time. Any changes will become effective when the revised Terms are published on this page and the “Last updated” date is changed. Your continued use of the Services after an update means that you accept the revised Terms.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the Services and their software, functionality, website designs, text, graphics, logos, trademarks, and other content are owned by or licensed to WAWebSender and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, revocable, and non-transferable right to access and use WAWebSender for its intended purposes.

Except where expressly permitted by law or by us in writing, you may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer, or otherwise exploit any part of the Services.

USER RESPONSIBILITIES AND ACCEPTABLE USE

You are responsible for how you use WAWebSender and for all content and recipient information used in connection with the Services.

By using WAWebSender, you agree that:

  1. You will use the Services only for lawful and authorized purposes.
  2. You are responsible for the contact lists, phone numbers, message content, files, images, templates, and other information you use with WAWebSender.
  3. You are responsible for obtaining any consent, authorization, or other legal basis required before contacting recipients.
  4. You will comply with applicable privacy, electronic communications, anti-spam, marketing, and data protection laws.
  5. You will not interfere with, disrupt, abuse, or attempt to gain unauthorized access to the Services.

You must not use WAWebSender to:

  • Send unlawful or unsolicited messages;
  • Send fraudulent, deceptive, abusive, threatening, or harassing content;
  • Distribute malware, phishing links, scams, or other harmful material;
  • Impersonate another person or organization;
  • Contact recipients in violation of applicable consent requirements;
  • Circumvent WhatsApp restrictions, security measures, or technical safeguards;
  • Infringe intellectual property, privacy, or other rights of third parties; or
  • Engage in activities prohibited by applicable law.

Features such as message personalization, sending intervals, templates, batch controls, or other workflow tools do not guarantee that a WhatsApp account will avoid platform restrictions.

We may restrict, suspend, or terminate access to the Services if we reasonably believe WAWebSender is being used in violation of these Terms or applicable law.

WHATSAPP AND THIRD-PARTY SERVICES

WAWebSender is an independent product and is not affiliated with, endorsed by, sponsored by, or officially associated with WhatsApp, Meta Platforms, Inc., or their affiliates.

WAWebSender is designed to work in conjunction with WhatsApp Web. Your use of WhatsApp remains subject to WhatsApp’s own terms, policies, rules, and technical limitations.

You are responsible for ensuring that your use of WAWebSender complies with applicable WhatsApp policies.

WhatsApp and other third-party platforms may change their features, policies, interfaces, technical systems, or account restrictions at any time. These changes may temporarily or permanently affect the operation or availability of certain WAWebSender features.

We do not guarantee that using WAWebSender will prevent WhatsApp from reviewing, limiting, suspending, or restricting an account. You remain responsible for your WhatsApp account, recipients, messages, and messaging activity.

SOFTWARE AND BROWSER EXTENSIONS

WAWebSender may provide browser extensions or other software as part of the Services.

We grant you a limited, personal, non-exclusive, revocable, and non-transferable right to use such software solely in connection with the Services and in accordance with these Terms.

You may not reproduce, redistribute, modify, reverse engineer, resell, sublicense, or commercially exploit the software except where expressly permitted by applicable law or authorized by us in writing.

SUBSCRIPTIONS AND PAYMENTS

WAWebSender may provide both free and paid plans. Features, usage limits, prices, and subscription periods may vary depending on the plan selected.

The applicable price and subscription details will be displayed before you complete a purchase.

Payments may be processed through third-party payment service providers and may also be subject to the applicable provider’s terms and policies.

If a paid plan is offered on an automatically renewing basis, the applicable renewal terms will be disclosed during the purchase process. You may cancel an eligible subscription before its next renewal.

If a payment is declined, reversed, or cannot otherwise be processed, access to paid features may be suspended or limited until payment is successfully completed.

You are responsible for providing accurate billing and payment information when purchasing a paid plan.

CANCELLATION AND REFUNDS

You may cancel an eligible WAWebSender subscription through the cancellation options provided with the Service or by contacting customer support.

Unless otherwise stated, cancellation will take effect at the end of the current paid subscription period.

Refund eligibility and refund requests are governed by the WAWebSender Refund Policy.

If there is any conflict between these Terms and the WAWebSender Refund Policy regarding refund eligibility or refund procedures, the Refund Policy will apply.

Canceling a subscription does not automatically entitle you to a refund.

SERVICE AVAILABILITY AND CHANGES

Because WAWebSender operates in connection with third-party platforms and browser environments, we cannot guarantee that every feature will always operate without interruption.

Certain features may become temporarily or permanently unavailable or operate differently because of:

  • WhatsApp Web updates;
  • Browser or browser-extension platform changes;
  • Changes to third-party systems;
  • Maintenance or product updates;
  • Security requirements; or
  • Legal or compliance requirements.

We may modify, update, suspend, replace, or discontinue parts of the Services where reasonably necessary to maintain, improve, secure, or adapt WAWebSender.

DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee uninterrupted availability, compatibility, reliability, performance, or suitability of the Services for any particular purpose.

WAWebSender does not guarantee specific message delivery, marketing, sales, account, or business outcomes resulting from use of the Services.

You are responsible for reviewing recipient information, message content, attachments, and other information before sending messages.

We do not control WhatsApp or other third-party platforms and are not responsible for account restrictions, suspensions, message delivery failures, recipient complaints, platform changes, or other consequences caused by third-party services or by your use of the Services.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, WAWebSender and its affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your access to, use of, or inability to use the Services.

This includes, without limitation, losses resulting from service interruptions, third-party platform changes, account restrictions, message delivery failures, loss of data, loss of revenue, or loss of business opportunities.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

PRIVACY

Your use of WAWebSender is also subject to the WAWebSender Privacy Policy, which explains how information is handled in connection with the website and browser extension.

Please review the Privacy Policy before using the Services.

TERMINATION

We may suspend or terminate access to all or part of the Services if we reasonably determine that you have:

  • Violated these Terms;
  • Used the Services unlawfully;
  • Misused or interfered with the Services;
  • Created a security or legal risk; or
  • Used WAWebSender in a manner that may harm other users, third parties, or the Services.

You may stop using WAWebSender at any time.

Any provisions that by their nature should remain effective after termination will continue to apply.
